TERMS AND CONDITIONS
TERMS, CONDITIONS AND CONTRACT FOR SERVICES AGREEMENT BETWEEN CLIENT
AND CABINET QUEEN.
DEFINITIONS
‘Agreement’ means this contract for services, including any schedule(s) or annexures attached or any addendum to this agreement that is in writing and signed by Cabinet Queen and the Client.
‘Building Act’ means the Building Act 2004 and all subordinate legislation.
‘Cabinet Queen’ means Cabinet Queen Limited and all employees engaged to provide the Services.
‘Client’ means [Details of Client to be inserted]
‘Confidential Information’ means any information, whether oral, written, electronic, or otherwise, disclosed by either party to the other in connection with this Agreement, which is not publicly available (excluding information in the public domain other than as a result of breach of this Agreement).
‘Contracted Labourer’ means additional contracted labour services which Cabinet Queen may engage from time to time if required in order to complete the service being provided to the client. Services undertaken by the Contracted Labourer shall include such tasks as driving the truck, assisting with loading, or unloading, lifts on installation that require two people or any other situation where additional labour is required at Cabinet Queen’s discretion.
‘Consumer Guarantees Act’ means the Consumer Guarantees Act 1993.
‘Intellectual Property’ means all intellectual property rights (including copyright, designs, patents, trademarks, know-how), whether registered or unregistered, created by or arising from provision of the Services.
‘Privacy Act’ means the Privacy Act 2020.
‘Project’ means the services provided in accordance with Cabinet Queen’s estimate/quote.
‘Services’ means cabinet making and joinery services including but not limited to the quoting, supply and installation of cabinetry, joinery work as per specification, repairs to existing joinery, custom building of joinery components, site measurements, or any additional work as otherwise agreed in writing between the parties.
‘Subcontractor’ means any person or entity engaged by Cabinet Queen to undertake any part of the Services on behalf of the Cabinet Queen.
GENERAL TERMS
1. Cabinet Queen will, at its own cost, put in place and maintain such insurance cover as is customary and appropriate for cabinet making and joinery services, including but not limited to public liability insurance and professional indemnity insurance (where applicable).
2. Upon request, Cabinet Queen shall promptly provide to the Client, certificates of currency evidencing all relevant insurance policies.
3. The terms of this agreement shall commence on the effective date, stated at the end of this agreement, and continue until installation of the project is completed and all of Cabinet Queen’s invoices are paid in full by the Client.
4. Cabinet Queen shall issue invoices to the Client itemising all fees for Services rendered, including GST (if applicable), and all pre-approved expenses.
5. The Client must pay Cabinet Queen’s invoice within 14 days of the invoice date. These payment terms reflect Cabinet Queen’s contractual obligations with suppliers and trades, who often require full payment prior to the release of materials, goods, or services.
6. Cabinet Queen is an independent contractor who must manage and coordinate all trades involved in the project. This is subject to mutual agreement by both parties upon execution of this Agreement.
7. Nothing in this agreement shall be deemed to create any employment, partnership or agency relationship between Cabinet Queen and the Client.
8. Cabinet Queen shall perform the Services to the highest industry standards and in accordance with all applicable laws and regulations, including:
(i) Health and Safety at Work Act 2015;
(ii) Building Act 2004 and all subordinate regulations;
(iii) Consumer Guarantees Act 1993 (where applicable);
(iv) All other relevant New Zealand statutes, regulations, and codes of practice.
9. In the event that the client is a company or a trust, the director or trustee signing on behalf of the Client is also signing in their personal capacity (jointly and severally) and unconditionally and irrevocably personally undertakes as principal debtor to pay everything that the company or trust owes to Cabinet Queen and to indemnify Cabinet Queen against non-payment or default. Any such personal liability of you as director or trustee will not exclude the company or trust from the liabilities and obligations contained in this agreement.
10. In the event of a dispute, the Parties agree to work towards a resolution through good faith negotiation. This Agreement constitutes the Parties entire understanding of their rights and obligations. This agreement supersedes any other written or verbal communications between the Parties.
11. Any amendments to this Agreement must be recorded in writing and signed by both parties. All requested amendments under this Agreement must be sent by email to Cabinet Queen at Admin@cabinetqueenwaikato.co.nz
12. This Agreement will automatically terminate when both parties have performed all of their obligations under the agreement, and all payments have been received.
13. By signing this agreement, the client is giving permission for Cabinet Queen to take before, during, and after photographs of the project for promotional purposes, documentation, insurance, warranty reference, and record-keeping purposes.
FEES AND PRICING
14. Cabinet Queen does not offer Free at-home Consultations or Quotes. In order to keep our pricing fair, transparent, and competitive with larger companies, we apply two fees per project, both of which must be paid upfront for full-service. These fees are outlined below, and represent the comprehensive processes carried out by a sole-trading business owner and project manager. If multiple projects are involved, fees will be reviewed on a case-by-case basis and may be charged individually or combined at Cabinet Queen’s discretion.
15. Fees apply for all consultations, insurance-related projects, and all cabinetry project types.
16. The Consultation Fee is $150 - 250 + GST (Weekdays) / $225 - 325 + GST (Saturdays). Please note this fee is time-based.
17. The Consultation Fee covers a comprehensive, in-person consultation where Cabinet Queen brings the portable showroom directly to your location. This service includes:
a. Full on-site measure
b. Design and layout discussions where Cabinet Queen drafts the design sketch and completes a extensive checklist.
c. Cabinet colour, benchtop selections (e.g. laminate, stone, stainless steel, natural timber), along with all other aspects of the project are chosen.
d. Appliance integration supplied through Cabinet Queen’s commercial account. Please note: Where existing appliances are to be integrated into cabinetry, the appliances must be no older than 3 years in order for Cabinet Queen to provide any warranty on surrounding cabinetry panels or associated work.
e. Hardware options e.g. Lazy Susans, Duplo’s, Cutlery Trays, Utensil dividers, Blum Space Towers, Soft closing bins, ETC.
f. Coordination of trades (Flooring, Splashbacks, Electricians, Builders, Plumbers, – Cabinet Queen’s Plumber in particular is highly recommended to uphold product warranties.
18. Cabinet Queen’s standard consultation service area is limited to the following boundaries. Travel outside these areas may still be accommodated; however, additional vehicle, fuel, and travel time charges will apply.
a. North: Huntly
b. South: Kihikihi
c. West: Waitetuna
d. East: Morrinsville
19. The Design and Quoting fee covers a detailed 3D design and quotation estimate which is between $150 - 325 + GST. This fee is also time-based dependent on the size and scope of the project. Payment of the design and quoting fee is required before any further estimate/quote is issued. The Design and Quoting fee includes:
a. Drawing your 3D plans using advanced cabinet software.
b. Gathering trades and supplier pricing for materials and hardware.
c. Producing a detailed and accurate estimated quote.
20. While Cabinet Queen is happy to work in project stages, please note that this may lead to increased costs, including:
a. Extra truck hire and transport for delivery.
b. Additional labour charges for multiple visits for both Cabinet Queen and the laborer.
c. Potential price increases from suppliers due to market changes
21. If a client requests a quote based on supplied plans, sketches, or images, the Consultation and Design Fees still apply. These fees are determined by Cabinet Queen upon engagement and are required before any quoting work begins. Please note that client-supplied plans are treated as a guideline only. A quote will only be provided once Cabinet Queen has completed the required consultation and design process. Furthermore, Cabinet Queen cannot offer any warranty on products or cabinetry unless a full site measure, detailed 3D design, supply, and installation are carried out directly by Cabinet Queen. This term is non-negotiable. Further details can be found under the Warranty section.
22. If a client requests an estimate based on kitset or client-supplied cabinetry, a Quoting Fee of $150 – 250 + GST applies. This fee includes:
a. Reviewing all supplied plans, documents, and product information
b. Communicating with the client to clarify scope and requirements
c. Confirming measurements
d. Assessing project complexity and installation feasibility
e. Preparing a detailed assembly / or installation estimate
f. Time and costs involved in preparing quotes for custom-made benchtops when requested alongside kitset services (including assembly or installation)
g. Appliance integration supplied through Cabinet Queen’s commercial account. Please note: Where existing appliances are to be integrated into cabinetry, the appliances must be no older than 3 years in order for Cabinet Queen to provide any warranty on surrounding cabinetry panels or associated work.
23. A minimum call-out fee of $100 – $150 + GST applies for small projects, minor repairs, or the retrofitting of specialty hardware. This fee includes travel within a 30-minute / 30 km radius of Cabinet Queen’s registered place of business and covers up to 30 minutes on site for assessment only, including travel and operational costs.
24. Following the Min call out assessment, a quoting fee of $100 – $150 + GST may apply, depending on the scope and size of the project.
25. Both fees are time-based and apply to assessment and consultation only, and do not include any labour, materials, or work carried out on site.
26. Cabinet Queen accepts no responsibility for inaccuracies or errors arising from client-supplied plans, measurements, or specifications.
27. If a quote is accepted and a deposit is made but then the client later changes their mind with product, or repeated “back and forth” plan revisions occur due to indecision, additional fees will apply to cover extra time, administration, and redesign changes.
28. If the quote has expired or is declined, or the client later requests design changes or reactivation, the following revision fees apply:
a. Minor revisions: $69 + GST
b. Major revisions or larger-scale changes: $138 + GST
29. If a project is placed on hold for more than 30 days, if the client does not engage within 30 days after the consultation or quote, or if changes are made due to indecision, the initial consultation and design fees will be required again when re-engaging with Cabinet
Queen. For best results and to avoid unnecessary charges, please ensure you are ready to proceed before initiating the Design and Quoting process All costs associated with obtaining building consent from the relevant territorial authority (if required) are the responsibility of the client.
CABINETRY AND OVERALL PROJECT PRICING
30. All quotes are ESTIMATES and subject to change upon work being carried out. Final invoicing will reflect actual costs. Final invoices may have a variability of 10–15% from initial estimate depending on site conditions, supplier price changes, or unforeseen circumstances. Cabinet Queen will be fully transparent if such events were to occur.
31. Cabinet Queen will source and supply all items for the project. Upon ordering, longer time frames or delays may occur which are outside of Cabinet Queen’s control. Please be mindful, considerate, and work with the leading Tradesperson. Every stage of the project is completed solely by Cabinet Queen, so patience and understanding are appreciated.
32. All screws and sundries necessary to assemble and install the cabinets, including finishing items, will be charged in the quote under Consumables. Cabinets are fully assembled and installed by Cabinet Queen and there will be no warranty for cabinets that are not supplied or assembled by Cabinet Queen.
33. ESTIMATE quotes where only labour is required by Cabinet Queen are valid for 7 days and subject to change upon alterations or extra time spent revising plans.
34. ESTIMATE quotes for full design, construction and installation by Cabinet Queen are valid for 30 days and subject to change upon client requested alterations or extra time spent revising the scope of services.
35. Any promotional discount offered is valid only within the 30-day quote period or until the stated promotional expiry date, whichever is the earlier. Outside these timeframes, standard pricing applies. These promotions are applied in good faith, offering substantial savings by factoring in suppliers, trades, and project management. After expiry, Cabinet Queen cannot guarantee the promotion remains, as it prevents misuse of time, resources, and professional contributions.
36. Renewal of a promotion after the expiry date will only occur if the client has provided reassurance to Cabinet Queen that they intend to proceed before the expiry date and will be at Cabinet Queen’s sole discretion.
37. A revision fee of $69 + GST or $138 + GST will be invoiced if the quote has expired, or if the client requests alterations after the quote has been issued. In some cases, revising a quote may require extra time beyond the standard scope, which Cabinet Queen will communicate before proceeding.
38. A deposit of 50% of the estimated quote secures Cabinet Queen’s services and all products for 30 days, excluding labour. We reserve the right to make price changes unless a deposit has been paid.
39. Deposits are non-refundable should the client change their mind.
40. Stone benchtop prices are only verified after the template has been done. Additional charges may apply for difficult access or extra travel costs.
41. Any flat-packed cabinetry or items quoted according to client-provided sizes remain the full responsibility of the client. Such items are not warranted by Cabinet Queen, as stated in this contract.
42. We endeavour to resolve but take no responsibility if items from a third-party supplier are made incorrectly or contrary to Cabinet Queen’s instructions, are out of stock, or increase in price. Cabinet Queen will communicate such issues if they arise.
43. Cabinet Queen cannot guarantee supplier prices will remain the same over time. For the most cost-efficient outcome, we recommend completing your project in one well-planned stage.
PAYMENT TERMS
44. Unless otherwise stated, GST is included in all prices.
45. For any project supplied and installed by Cabinet Queen, a 50% deposit of the total quoted project cost is required prior to the commencement of any work. Payment of this deposit confirms the client’s acceptance of the quoted scope of services and these Terms and Conditions, forming a binding agreement between the client and Cabinet Queen regardless of whether a physical or electronic signature has been provided. The deposit allows Cabinet Queen to begin project scheduling, ordering of materials, and production.
46. Any changes requested after the deposit has been paid are at Cabinet Queen’s discretion and may incur additional costs where alterations affect materials, labour, design, or project timelines.
47. Full payment of the quoted project amount must be received before any cabinetry, benchtops, accessories, repair work, insurance work, delivery, or installation services will be released, scheduled, delivered, or installed under any circumstances.
48. Where a deposit is paid to secure materials, those materials may remain the property of the supplier until full payment of Cabinet Queen’s invoice has been received. Materials will not be released, delivered, or installed until full payment has been made.
49. For projects where plans and/or cabinetry are supplied by the client, including flatpack cabinetry, Cabinet Queen will provide an estimate only. Upon acceptance of the estimate to install the flatpack, a 50% deposit is required upfront. The remaining 50% balance is due by 5:00 pm on the day installation is completed, with no exceptions.
50. Failure to make payment by this time will result in the outstanding amount being immediately referred to a debt collection service, who will take over recovery of the outstanding balance. Any debt recovery costs incurred will be payable by the client together with interest on the overdue debt.
51. The lead time for the full completion of a project may vary from estimates provided due to delays from suppliers or circumstances outside of Cabinet Queen’s control. Cabinet Queen will endeavour to keep the client updated regarding any changes to estimated completion dates.
52. Where materials have been ordered but fabrication has not yet commenced, Cabinet Queen may allow adjustments to the order at its discretion. Any approved changes will result in the final invoice being amended to reflect variations in materials, labour, or production costs.
53. If payment is made by Internet Banking, sufficient time must be allowed for funds to clear before the order will be accepted and processed.
54. Credit card payments (Visa and MasterCard only) will incur a 2.5% surcharge.
55. Payment to Cabinet Queen is required by Internet Banking into the following account:

57. Overdue invoices will incur interest at a rate of 2% per month.
58. Any outstanding invoices exceeding 60 days may be referred or sold to a debt collection agency at the client’s cost, unless alternative payment terms have been agreed to in writing.
59. These payment terms are strictly enforced, and clients must ensure they fully agree to these terms prior to placing an order.
60. Upon acceptance of a quote or estimate, the client agrees to the following chargeable rates where applicable:
61. The Client agrees to pay Cabinet Queen’s hourly rate of $95 + GST
a. The Client agrees to pay Cabinet Queen’s travel hourly rate of $47.50 + GST
b. The Client agrees to pay the contracted labourer’s hourly rate of $65 + GST
62. Cabinet Queen’s vehicle, the labourer’s vehicle, and any rental vehicle may incur a per kilometre mileage charge of $0.95 per km, which includes fuel costs.
63. Cabinet Queen’s usual hours of work are Monday to Friday, 7:30 am to 5:00 pm, excluding public holidays unless otherwise agreed in advance.
64. If work is carried out on a public holiday, Cabinet Queen’s hourly rate increases to $120 + GST per hour.
65. If Saturday work is requested, Cabinet Queen’s hourly rate increases to $120 + GST per hour, while the contracted labourer’s rate increases to $90 + GST per hour. Sunday labour is not available unless agreed to in writing prior to the scheduled works.
INSTRUCTIONS AND MODIFICATIONS
66. Due to the risk of error or miscommunication, any changes to design, hardware or specification / dimensions, or any other specific instructions relating to your project will only be accepted prior to the first 50% deposit or will result in additional costs charged to the client to pay the supplier the costs required.
67. It is the full responsibility of the client to review and confirm their satisfaction with all colours, hardware, specifications, contracted trades tasks associated and 3D drawings prior to paying any deposits and proceeding toward installation.
68. All appliance model numbers must be confirmed prior to the first 50% payment being made to produce the cabinets to suit and if any appliance model numbers are changed without informing Cabinet Queen additional costs will occur.
69. Assembly and pre-setup of the cabinetry e.g. the surrounding coloured panels / bulkheads is required by Cabinet Queen for the project’s efficiency and accuracy prior to installation.
70. Should the client request any changes to the approved plans or supplier products that result in the uninstallation or reinstallation of cabinetry, the client will be fully responsible for all associated labour and consumable costs incurred by Cabinet Queen.
71. If the client intends to make major changes to the project or no longer wishes to proceed, they must notify Cabinet Queen promptly and provide the reason for the decision. Timely communication ensures that Cabinet Queen can formally close the project and dedicate resources to active projects.
72. Any changes or alterations to the project after the client has paid the 50% deposit are at Cabinet Queen’s discretion and may incur additional costs, delays, or variations to the agreed project scope.
73. Where a client or company requests Cabinet Queen to contract to their business to assemble / install their products the following services will be charged out on the invoice. The invoice will be split so the client must pay 50% upfront and the remainder 50% on the day of completion of the assembly and installation.
74. Services Include:
a. Cabinet Queen’s contracted hourly rate is $75 + GST. This rate reflects the experience and expertise provided and contributes toward essential business costs including GST, ACC, tax obligations, sick leave, annual leave, and insurance, as well as the maintenance of tools and equipment. This rate excludes vehicle charges and consumable materials, which will be charged separately where applicable.
b. Cabinet and Component Rate - E.g. Base Cabinet, Tall Cabinet, Filler, Toe kick, Skirtings Cut, Etc
c. Consumables used e.g. Cover caps, screws, silicones, gap fillers, adjustable shelf studs, all other products required to build and install.
d. Business Vehicle Kms and Fuel Charge apply from Cabinet Queen’s workshop to the contractor’s client site or client workshop.
75. The Terms between the client and Cabinet Queen must be agreed in writing between both parties to state the above Terms for
Contracting out before any work commences.
CABINETRY DESIGN AND COPYRIGHT
76. All plans, designs and CAD files remain the intellectual property of Cabinet Queen until such time that installation of the project is complete and full payment has been received.
77. CAD plans and all attachments emailed to the client are confidential information and cannot be shared, downloaded or printed out to share with friends / family or other Cabinetry businesses. This secures Cabinet Queen's expertise and information. This is underwritten in the Privacy Act 2020, and if copyright infringement was to occur, Cabinet Queen reserves the right to pursue legal action. .
78. The CAD Drawings and final plans that are supplied by Cabinet Queen and given to the client act as a visual representation of the format and assist with the visualisation of the cabinetry project at hand e.g. the kitchen, laundry wardrobe etc.
79. We will endeavour to custom the design to the client’s requirements, however we take no responsibility for any last minute changes after the first 50% deposit payment is made.
80. Cabinet Queen will require additional costs to fulfil any set changes which are stated in the ‘Instructions and Modifications’ section.
81. Other tradespeople may use these drawings at their own risk and Cabinet Queen takes no responsibility for any work done by others based on these drawings.
82. It is the responsibility of the client to ensure that the drawings conform to plumbing, gas fitting, electrical or any other building regulations or any provisions of the Building Act 2004.
83. If in doubt the client should seek the advice of a builder, plumber, electrician or other qualified professional.
DELIVERY
84. A rental such as a van or truck may be required to deliver the assembled cabinetry and surrounding panels.
85. A bond is required for a truck, van or trailer covering KMs travelled, fuel and a security deposit on the remainder for unforeseen circumstances, this bond does not get refunded back to the client.
86. A delivery fee will apply to all projects requiring transportation of cabinetry or materials. This fee covers the rental costs, non-refundable bond charges, kilometres travelled, and fuel costs. Rental vehicle pricing may vary depending on the size of the vehicle required for the project.
87. Delivery may be carried out by a one or two person team, depending on the size and requirements of the project.
88. Delivery will be completed Monday - Friday, during normal business hours, door to door.
89. If the delivery driver is able to safely access the property and park the truck close to the entry point, unloading will proceed under standard conditions.
90. Where driveway access or site conditions prevent the truck from reaching the entry point, resulting in additional time, labour, or handling required to unload the project, Cabinet Queen reserves the right to charge additional costs for the unforeseen labour and time incurred.
91. Assistance will be provided by the Contracted Labourer if the project involves tall units, panels, benchtops, heavy items, or any two person lifts. Under no circumstances, is the client to assist Cabinet Queen.
92. In some rare occurrences, delivery may be postponed to ensure a safe delivery of the items.
93. A minimum of 3 days' notice must be given of any changes to the scheduled delivery date from either party.
94. If the client requested the items to be left without being present, they are accepting full responsibility of the items in the event of theft or if they are damaged from weather events.
95. The client is to provide Cabinet Queen with as much information as possible on the location prior to delivery, (e.g. Gate codes, steep driveways, multiple or better access driveways for the truck, dogs being loose), to ensure safe, efficient and on-time delivery.
96. It is the client's responsibility to ensure adequate site access and secure storage for delivered goods. If this has not been done then Cabinet Queen is obliged to return to site at another time to deliver, where additional charges may incur
97. Full and clear access to the property and installation area must be provided at the time of delivery so cabinetry can be safely unloaded and stored inside the premises and close to the installation location. Cabinetry must not be stored outside under any circumstances.
REMOVAL / DUMPING OF OLD CABINETRY
8. Cabinet Queen offers removal / dumping of old cabinetry at a rate of $95 + GST per hour.
99. Cabinet Queen may include, as an optional service within the quote, the removal and disposal of existing cabinetry, benchtops, and associated materials.
100. This service will include labour and dumping fees where applicable.
101. A rental trailer may be required for dumping existing cabinetry, appliances, and all rubbish for the project if the client requests this upon consultation, this cost will be incorporated into the Dumping Service.
INSTALLATION
102. Under no circumstances is Cabinet Queen or their subcontractors to stay overnight at the client’s offered accommodation or residency, this is strictly enforced for privacy, and personal / professional boundaries. If the client refuses to agree to this Term Cabinet Queen reserves the right to withdraw their services.
103. The site must be fully prepared for Cabinet Queen to commence installation. This includes completion of all electrical and plumbing adjustments, and the installation area must be cleared and accessible upon delivery. If the site is not ready as required, any delays or additional labour will be charged in full to the client.
104. On the date of installation there must be clear access in the driveway for the truck to reverse in and allow for a tail lift. Driveway must have the appropriate room for delivery and unloading.
105. On installation there must be full and clear access to and from the space where the work is being installed by Cabinet Queen.
106. It is highly recommended that all young children and animals are kept clear of the installation area for safety reasons. Any delays caused by children, animals, or client interference will result in additional labour costs, as outlined in this contract.
107. While the installation is being fulfilled Client must be respectful, mindful and above all keep the professional boundaries.
108. While Cabinet Queen is working, its best to leave all staff involved to their projects as any disruptions can set the labour and project timeframe back immensely. Unless Cabinet Queen or other trades are initialising the interaction. This is very important as this affects the overall project pricing and may result in an additional invoice after the project has been completed.
109. It is the client's responsibility to coordinate with Cabinet Queen. Cabinet Queen then needs to coordinate with the plumber and electrician either supplier by the client or Cabinet Queen to then do the full project managing.
110. Cabinet Queen’s liability is limited to the replacement of faulty goods only and does not include the costs of removal or re-installation. Note: some panels are supplied over-sized to allow scribing by the installer - if required. All panel sizes must be checked before installation by Cabinet Queen.
111. Under no circumstances is Cabinet Queen to pay for any other trades or unexpected work for the project to then be installed - E.g.
plumbing/ gas fitting, electricians, or builder’s adjustments required. This work must be completed and ready prior to cabinetry installation if required.
112. Any alterations required to plumbing, electrical or the house that may affect the installation is the responsibility of the client. Cabinet Queen is not to be held accountable unless Cabinet Queen has missed crucial information to what is required by the trades involved.
113. For all flat pack installation inquiries, Cabinet Queen must be provided with a detailed written scope outlining the complexity of the project, PDF files supplied directly by the flat pack manufacturer or supplier, and clear images of the existing installation space.
114. This information assists Cabinet Queen in accurately preparing an estimate and in determining, communicating with, and coordinating any required trades or additional information prior to installation. Failure to provide full and accurate information may result in the estimate being exceeded, and any additional costs incurred will be the client’s sole responsibility.
115. If Cabinet Queen is engaged to install a flat pack project where two-person lifts are required, the client automatically agrees that Cabinet Queen Contracted Laborers will be engaged. This is necessary to meet health and safety requirements and to ensure efficient, manageable installation for Cabinet Queen as a sole trader. Under no circumstances is the client permitted to assist with installation works.
RETURNS / REFUNDS
116. Surcharges associated with payment by credit cards will not be refunded.
117. If the client was to cancel the project due to grievances or concerns Cabinet Queen will only refund what is due to the client excluding labour already fulfilled by Cabinet Queen. The client will receive the product flat-packed / costs of good that have already been paid by the client.
118. Cabinet Queen will track labour quoted and will only provide a refund if set hours are completed well inside the quoted hours. If the client has only paid 50% then no refund will be given as cost of goods / labour are only just being covered in the first 50% instalment.
119. Cabinet Queen will not accept returns or refunds after installation due to change of mind, so please confirm everything in the quote adequately. For example, if a cabinet does not meet the client’s requirements, or you change your mind about the colour or finish, we are unable to accept returns.
120. If an item is faulty we will meet our obligations under written by my suppliers Terms and Conditions, and Warranties and the provisions of the Consumer Guarantees Act 1993.
LEAD TIMES
121. Installation by Cabinet Queen, along with any trades coordinated by Cabinet Queen, can generally be expected within approximately 4 to 14 weeks from receipt of the initial 50% deposit. This timeframe may vary depending on the projects size and scope, Cabinet Queen’s current schedule and workload, the client’s location, coordination and availability of all trades involved, client’s communication, and overall project planning. Delays may also occur due to unforeseen circumstances outside of Cabinet Queen’s control.
122. The estimated lead times may vary due to factors such as supplier factory workloads, staff availability, material supply issues, or other unforeseen circumstances.
123. If any delays occur, Cabinet Queen will inform the client in advance. However, no consequential claims or compensation will be accepted for any reasonable delays beyond the quoted lead time.
124. The flat packed Melamine components can be ready for collection from the supplier in approximately 10-15 working days unless unexpected delays have occurred from their third party supplier. Then Assembly and Pre-set up can occur by Cabinet Queen.
125. Designatek Profiled Panels / fronts can be ready for dispatch in 5-15 working days depending on the finish requested from the client.
126. Laminate tops can be ready for dispatch in approx. 3.5-5 weeks after templates have been completed or final measurements have been taken. Not all locations can be supplied laminate tops by my suppliers.
127. Stainless and Stone tops can be ready for dispatch in approx. 5-15 working days after templates have been completed or final measurements have been taken. Not all NZ locations can be supplied stainless or stone tops by my suppliers.
128. Solid Timber Floating Shelves or Benchtops can be expected in approximately 5-15 working days from ordering.
129. Glass Splash-backs have an estimated turnaround for installation of 10-20 days from templating.
WARRANTIES
130. The entity giving this warranty is Cabinet Queen.
131. To ensure full warranty coverage on all cabinetry and parts installed around water-connected areas — including dishwashers, washing machines, and plumbed-in fridges. The following conditions apply:
132. The client’s plumber must be a certified tradesperson, and proof of certification must be provided to Cabinet Queen prior to any work commencing.
133. This warranty excludes any damage or issues resulting from client misuse, negligence, or improper installation of appliances or plumbing connections.
134. Cabinet Queen can alternatively arrange for a contracted certified plumber to complete the required plumbing works, and this cost can be included in the quoted estimate for convenience and warranty assurance.
135. For all clients to receive the full warranty on any products quoted and supplied by Cabinet Queen, Cabinet Queen must complete a physical site measure, supply all materials, and carry out the fabrication and installation of all cabinetry and related products for the project. Cabinet Queen will not supply or install based on client-supplied plans or measurements. This term is strictly non-negotiable and is in place to protect both parties from errors, discrepancies, and any potential legal obligations arising from inaccurate or incomplete information.
136. In the event of any leaks from plumbing, old appliances, heat damage from incorrect use of appliances or potential mistreatment of the products where the client has not wiped away such spillage which may result in swelling or PVC damage from constant long exposure will not be covered under warranty and replacement parts must be covered at the clients discretion, some products supplied by Cabinet Queens suppliers are merely only Water Resistant not Waterproof.
137. All WARRANTIES and CARE AND MAINTENANCE documents will be sent to client upon completion, for the cover of all products supplied by third parties of Cabinet Queen.
138. Subject to proof of purchase and the terms of this warranty statement, Cabinet Queen warrants to the original purchaser of suppliers products stated below, that the product will, subject to compliance with the conditions below, be free from defects due to defective factory workmanship or materials.
139. The warranty period in respect of the product type is as follows:
a. Designatek Colour - 10 Year Warranty
b. Melamine from the 3 suppliers and Manufactured by Cabinet Queens Flat packer (Intawood) – 10 Year Warranty
c. Blum Hardware – Limited Lifetime Warranty (Refer To Blum's Guidelines)
d. Hettich Hardware - 10 Year Warranty
e. Rocket Hardware – Tapware is 10 years, Sinks are 25 years.
f. Integrity Sinks - 10 Years from the Date of Purchase
g. Fit Warranty – Non Electrical Products = Lifetime warranty, 2 years for electrical products.
h. ENKO - 10 Years Warranty Archant Warranty – 12 Months LED Stuff - 24 Month Warranty
i. Glass Splash back - 10 Years from Defects in Workmanship and Materials from Completion Date.
j. Flooring Xtra - Laminate, Carpet, Vinyl, Timber, LVT, Hybrid - All Flooring Types will have a specific Warranty Period of 5, 10, 15 or 20 years from the date of purchase and will be specified on the invoice sent to client - Warranty Period Will also depend if its Residential or Commercial.
k. Stone Benchtops – 10 years for the materials, 5 years for the warranty of joins and workmanship. Laminate Benchtops – 4 Years k. l.
Stainless Benchtops - 15 year Warranty
l. Appliances - All Models will have their own Manufacturer’s warranty so Cabinet Queen will register the product upon receiving the serial number and all Warranty Claims must come directly through Cabinet Queen, who will organise the repair or replacement of parts.
m. (Terms and Conditions Apply on all the above supplier’s website.) 140. The warranty period commences from the date of installation on site.
141. This warranty does not apply to any products sold as seconds, display stock or products identified as having a defect. This warranty represents the only warranty given by Cabinet Queen, and no other person(s) or organisation is authorised to offer any alternative. If a claim has been successful, some items may not be in stock as they may require production in order to be supplied. This estimated time of production is variable due to factory conditions, supply chain management, and is subject to wait times exceeding what may normally be expected for an item which has been purchased.
142. Cabinet Queen Reserves the right to provide an estimated time-frame in which the item will be produced, but this is subject to change. We will try to notify you of any changes where possible.
CONDITIONS OF WARRANTY
143. This warranty is strictly subject to the following conditions:
144. Cabinet Queen will not be liable for breach of warranty unless the claimant has a valid claim and submits a claim in writing to Cabinet Queen or the authorized distributor the product was purchased from.
145. The written claim must be made within 30 days from the installation date and defect would have become reasonably apparent, or if the defect was reasonably apparent prior to installation, then the claim must be made prior to installation.
146. If an item is installed, and later found to have been defective, the claim will be determined on a case-by-case basis. Defective items should not be installed, as installation is an indication of accepting the condition to be fit for installation.
147. The claim to Cabinet Queen must include the following:
a.Proof of purchase.
b.The name of the original purchaser and the order number that the product was purchased in. The date on which the defect became apparent.
c.The name of the affected product and description of which part of the product is affected.
d.Photos of the affected product, including a close-up of the fault or defect, and if possible, a photo of any labels on the product or packaging it was packed in.
148. The warranty is personal to the original purchaser of the product purchased and used in New Zealand and is not transferable. The product must be installed in accordance with all applicable legal requirements.
149. The claimant agrees to provide information in relation to the installation and/or maintenance of the product reasonably requested by Cabinet Queen in assessing any claim.
150. All other products applied to or used in conjunction with Cabinet Queen products, must be applied, used, installed and maintained in accordance with the relevant manufacturer's instructions.
151. This warranty does not cover:
a. Products not purchased from an authorised Cabinet Queen distributor.
b. Products which have not been paid for in full.
c. Products which are re-sold or re-supplied or constitute second-hand goods.
d. Normal wear and tear.
e. Usage other than normal personal, domestic or household use.
f. Assembly and installation that is not in accordance with supplied instructions.
g. Defects which have been disclosed as a feature or limitation of the products in any literature published by Cabinet Queen.
h. General colour fading, discolouration or damage due to direct and indirect light (exposure to direct sunlight should be avoided).
i. Slight variations or differences in the visual features of the products inherent within the manufacturing process.
j. Damage caused by accident, misuse, abuse, negligence, improper handling or failure to follow supplied care and maintenance directions (please refer to the website or documents sent for maintenance and care guides).
k. Damage resulting from exposure to excessive heat, moisture, ultraviolet light or physical or chemical abuse that the product is not designed to withstand (such as, but not limited to, oven cleaners, floor and paint strippers, and other harsh chemicals).
l. Damage or problems resulting from alteration, modification, incorrect adjustment, operation or repair or use of the product which is inconsistent with supplied product instructions (such as, but not limited to, cutting a product and failing to seal the cut edge appropriately), or using with inappropriate accessories.
m. Damage, problems or failure caused by acts of God or natural disasters including but not limited to fire, wind, lightning, flood, storm, vandalism, earthquake, war, civil insurrection, pests, vermin, insects, spiders, microorganisms, or interference by foreign objects or matter affecting the product such as dirt, debris, soot or moisture.
n. Damage, problems or failure caused by extreme weather conditions, including, but not limited to, hail, salt, or other harsh substances.
o. Products which have been installed in an outdoor setting, or a portable or mobile building, structure or application including, but not limited to, a caravan or boat.
p. Products which are re-installed at a location other than the original installation site.
q. Damage or problems resulting from inadequate support or design of the structure to which the product is installed.
r. Products where repairs have been made or attempted by a service provider other than one approved by Cabinet Queen.
s. Products which have infinitesimal defects, such as hair-line scratches, will not be replaced under warranty. These defects must be visible from 600mm away in natural interior lighting, or 1000mm away when viewing the defect from an angle of 45 degrees. For more information on the MBIE building code standard, which is used for the purposes of determining faults in accordance with the Building Act 2004, please visit www.building.govt and find the relevant documents relating to 'Tolerances, materials and workmanship.'
t. With regards to measurements advertised, standard sized doors will be usually 3mm less than the overall cabinet size. For example, a 400mm base cabinet will have a door of 397mm width as a standard size. Our upper and lower tolerance for sizing faults is ±2mm, meaning a door which is 395~399mm would be considered non-faulty with regards to the example above.
u. With regards to doors and/or panels bowing, our upper and lower tolerance is set at the standard of 3mm per meter of door or panel. This measurement is taken by placing the panel or door on a completely flat surface and measuring the distance at the widest point between the flat surface and the door. For example, a 2-meter door would have a tolerance of up to 6mm.
152. Cabinet Queen warrants that it will, at its discretion, as sole remedy for breach of this warranty elect to:
153. Supply a replacement for the defective product; or
154. Rectify or repair the defective product; or
155.Pay the cost of the replacement or rectification of the defective product.
156. If a defective product is repaired or rectified, the original warranty period will continue to apply based on the original date of purchase of the relevant product.
157. If the affected product has been discontinued, Cabinet Queen may offer, at its option, a replacement with a similar product. Cabinet
Queen does not warrant that replacement will fit any existing fixtures or chattels, which include, but is not limited to, appliances and/or components, sinks, taps, dishwashers, ovens, stovetops, range-hoods, plumbing, electrical, flooring, windows, walls, ceilings and other cabinetry or furniture.
158. All guidelines and recommendations provided by Cabinet Queens' trades, suppliers, and fabricators must be adhered to in accordance with their respective Terms and Conditions and Warranties.
159. Example: All cable ports installed into any bench-top material must be glued securely into the hole. This is a mandatory requirement to avoid voiding the manufacturer's warranty and is considered the safe and proper installation procedure for cable ports.
160. In order to assess a claim, it is the claimant's responsibility to arrange the return of the product in question to Cabinet Queen for assessment.
161. The claimant may be charged a fee for labour or service if:
a. The issue with the product is not covered by this warranty
b. There is no fault or defect with the product.
162. Cabinet Queen is liable only to the extent of the amount paid to us for products, and/or the costs associated with completing any remedial or repair work which is determined to be as a result of Cabinet Queen failing to comply with the aforementioned guarantees.
163. In no event shall Cabinet Queen be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the products, even if Cabinet Queen are aware of the possibility of such damages and known defects.
164. To the maximum extent permitted by law, all warranties, conditions, liabilities and obligations other than those specified in this warranty are excluded. These warranty exclusions apply only to the extent permitted by the New Zealand Consumer Guarantees Act 1993.
COVID-19 AND DISEASE
165. If either party or any members of their household tests positive for COVID-19 or any other publicly notified disease outbreak, they must inform the other party immediately so rescheduling can occur at time which is mutually convenient to both parties.
166. Rescheduling under those circumstances will occur at no penalty to either party.
DEPOSIT AND OWNERSHIP OF MATERIALS SECURED
167. When a client chooses to secure materials prior to the commencement of work, Cabinet Queen will issue a separate Securing Materials Contract specific to this purpose.
168. Payment of a deposit for materials, being a 100% payment toward the quoted amount, constitutes the client’s full acceptance of these Terms and Conditions and forms a binding contract between both parties, regardless of whether a signature has been provided.
169. All materials secured with the deposit will remain the property of the supplier until:
a. The full estimated quote is formally accepted by the client, and
b. 100% of the total estimated amount is paid in full prior to the commencement of any installation or work by Cabinet Queen and/or its associated trades and suppliers in accordance with the ‘Payment Terms’ section above
170. This policy aligns with the terms of both Cabinet Queen and its suppliers, ensuring protection against project delays, cancellations, or client “change of mind” once materials have been secured.
171. The deposit serves four purposes:
a. Stocking Fee
Covers the cost of holding, reserving, and managing limited-stock, clearance, or special-order materials on behalf of the client until they are ready for fabrication or installation.
b. Risk Coverage
Protects Cabinet Queen and its suppliers from financial loss if the client decides not to proceed after materials have been secured, reserved, allocated, or ordered.
c. Restocking Fee
Cabinet Queen reserves the right to apply a restocking fee of $450 + GST for any returned or cancelled items. This fee covers admin, handling, processing, and repackaging requirements. Please note: Custom, special-order, or supplier-restricted items may be non-returnable or may carry a higher restocking fee, in accordance with the supplier’s Terms & Conditions.
d. Supplier Freight Costs
A freight charge of $250 + GST applies when cancelling or requesting a refund for secured stone materials. This fee is charged by the supplier and is non-negotiable.
